Summary

Plaintiffs claim that Lake Michigan Credit Union (Defendant) improperly assessed Relevant Fees.

Defendant denies that it did anything wrong. Defendant claims that it was allowed to assess these fees, and properly did so in accordance with the terms of its account agreements and applicable law.


YOUR RIGHTS AND OPTIONS

You have two options under this Settlement, each of which is discussed below. You may: (A) remain in the Class and receive a settlement payment; or (B) exclude yourself from the Class and from the Settlement. If you choose to remain in the Class, you may also object to the Settlement, as explained below.

OPTION A. Remain in the Class.

If you wish to participate in the Settlement and receive a settlement payment, you do not need to take any action, as you will automatically be entitled to receive the benefits under this settlement. You do not need to submit a Claim Form in order to receive settlement benefits. By not opting out of this settlement, you are consenting to the terms of the Settlement. Lake Michigan Credit Union will not retaliate against any person who participates in this Settlement.

Provided that you do not submit an exclusion request and the Court grants final approval of the Settlement, the Settlement Administrator will mail your check to the last known address on file for you. 

OPTION B. If You Do Not Want To Be Bound By The Settlement.

If you do not wish to participate in the Settlement, you can exclude yourself from (or “opt out” of) the Settlement. To exclude yourself from the Settlement, you must submit a timely and valid written request for exclusion to the Settlement Administrator. If you exclude yourself from the Settlement, you will no longer be a Settlement Class Member and will not receive an Individual Settlement Payment.

The request for exclusion must contain: (1) your name, address, telephone number, and (2) your signature or the signature of your legal representative; (3) the case name and number (Jones v. Lake Michigan Credit Union, Case No. 20-000240); and (4) a clear statement indicating that you wish to exclude yourself from the Settlement.  Your written request to the Settlement Administrator must be postmarked no later than August 18, 2022.

Objecting to the Settlement


 If you have not submitted a timely exclusion request or Opt-Out, you can object to any of the terms of the Settlement before the Final Approval Hearing. To object to the Settlement, you must mail a written statement of objection (“Notice of Objection”) to the Settlement Administrator postmarked no later than August 18, 2022.

To be valid, a Notice of Objection must contain all of the following: (1) your signature, or the signature of your legal representative; (2) your full name; (3) your address; (4) the case name and number (Jones v Lake Michigan Credit Union, Case No. 20-000240); (5) your telephone number; (6) a clear statement indicating that you wish to object to the Settlement; (7) the basis for your objection; and (8) whether or not you intend to appear at the Final Approval Hearing.

Final Approval Hearing

The Court will hold a Final Approval Hearing at the Washtenaw County Circuit Court, 101 E. Huron St., Ann Arbor, MI 48104 on September 28, 2022, at 1:30 p.m.  At this hearing, the Court will determine whether the Settlement should be finally approved as fair, reasonable, and adequate. The Court will also be asked to approve Class Counsel’s request for attorneys’ fees and litigation costs, the Class Representatives' Service Award, and the Settlement Administration Costs. 

The Final Approval Hearing may be continued without further notice to the Class Members. It is not necessary for you to appear at the Final Approval Hearing. However, you have the right to attend the Final Approval Hearing.
